Copyright issues especially related to recorded work is a large subject. For the purpose of recording it is suffice to say that no one is allowed to take a song or tune written by someone else and just record it and sell or even give the completed work or works to anyone else.  However there are certain permissions that can be obtained to overcome these limitations.  

 

The mechanical rights of a recorded work are looked after, for a large percentage of songs in circulation, by the MCPS-PRS Alliance. They grant licenses to allow recorded works to be distributed within the limitations of the license.  They can for example grant a license to allow the manufacture of up to a maximum of 2000 CD copies.  The cost with this maximum 2000 copy limit is lower to aid the smaller production companies or individuals who do not need a high production run of their CD. For reproduction copies of works above 2000 a different license structure comes into force, the AP2 Audio Product License. In this case each CD copy will attract a percentage of the selling price.

 

What the licence covers:

Subject to the terms and conditions and payment of the appropriate fees, the recording of MCPS members’ musical works onto an audio only or audio-visual production.
